Health Care Security Ordinance (HCSO)

New in 2012!

The following changes took effect on January 1, 2012:

 

1. The 2012 Health Care Expenditure Rates for medium-size and large businesses and the 2012 Annual Salary Exemption figure are posted below.

 

2. All "Covered Employers" -- businesses with 20 or more employees and nonprofit organizations with 50 or more employees -- must post the 2012 Official OLSE Notice at every workplace or job site. (PDF in 6 languages)

 

3. There are new rules and requirements for employers that impose a surcharge on customers to cover, in whole or in part, the costs of the HCSO spending requirement.

 

4. There are new rules and requirements for employers that utilize reimbursement accounts to satisfy, in whole or in part, the HCSO spending requirement.

Overview

Effective January 9, 2008, the Health Care Security Ordinance (HCSO) requires Covered Employers to spend a minimum amount of money each quarter on their Covered Employees' health care.  For detailed information on the law's requirements, please see the Frequently Asked Questions and Regulations below.

2012 Health Care Expenditure Rates
The 2012 health care expenditure rate for large employers (100+ employees) is $2.20/hour. For medium-sized employers (20-99 employees), the rate is $1.46/hour.

2012 Annual Salary Exemption Figure
An employee who is a manager, supervisor, or confidential employee and who earns at or above an annual salary of $84,051 (or $40.41/hour) in 2012 is exempt from coverage under the HCSO. (The 2011 annual salary figure is $81,450, or $39.16/hour.) Please review Regulation 3.2(A)(1) for a detailed definition of a manager, supervisor, or confidential employee.
