The current HCAO Minimum Standards will remain in effect through 2014.
The HCAO requires that the San Francisco Department of Public Health (DPH) review the Minimum Standards at least once every two years to ensure that they stay current with the state and federal regulations and existing health benefits practices. Covered employers must offer a plan compliant with the current standards, or pay the fee to San Francisco General Hospital. When the Minimum Standards were last reviewed in 2012, DPH decided that it would reconsider them the following year to ensure compliance with the Affordable Care Act (ACA). After this was announced, the federal government delayed the ACA’s employer mandate, which will not be in effect until 2015.
Because of this delay, DPH has opted to keep to its usual schedule of reviewing and modifying the Minimum Standards once every two years. This will allow DPH, in conjunction with its partners in this effort, to conduct this review with more detailed information regarding the ACA. DPH will undertake this review of the Minimum Standards in 2014. Changes will be announced in time for employers to find compliant plans with a January 1, 2015 effective date.
